Conditions of Carriage
Carrier’s Conditions of Carriage: These can be found at www.celestyalcruises.com/en/conditions-of-carriage and/or may be provided upon request. These conditions govern the relationship and responsibilities between the Passenger and the Carrier and are MANDATORY TERMS THAT MUST BE COMPLIED WITH WHETHER YOU READ THEM OR NOT.
“Carrier” means the owner/charterer or operator of the ship or any other person who assumes the role of carrier. (According to the definition stated in the Athens Convention. Where the 2002 Protocol to the Athens Convention applies, “Carrier” means a person by or on behalf of whom a contract of carriage has been concluded, whether the carriage is actually performed by that person or by a performing carrier.
Transferability: The Carrier agrees to carry the person(s) whose name appears on the NON-TRANSFERABLE e-ticket, on which the date, ship, cabin type, and substitute ship, if any, are specified. THE E-TICKET MUST BE PRESENTED AT CHECK-IN. YOU MUST CHECK IN AT LEAST 2 HOURS BEFORE DEPARTURE. Liability for Death, Injury, and/or Loss of or Damage to Baggage The Carrier’s liability, if any, for the physical injury and/or death of passengers and/or loss of or damage to baggage during the voyage shall be determined in accordance with EU Regulation 392/2009 (hereinafter referred to as the “Regulation 392/2009”) or, where applicable, the Athens Convention and, from 23 April 2014 where applicable, the 2002 Protocol to the Athens Convention. The provisions of Regulation 392/2009 and, where applicable, the 2002 Protocol to the Athens Convention or the Athens Convention are expressly incorporated herein into the Conditions of Carriage. A copy of the Athens Convention is available upon request or can be downloaded from www.celestyalcruises.com/en/conditions-of-carriage. Under Regulation 392/2009 and the Athens Convention, where applicable, the Carrier shall be presumed to have delivered baggage to the passenger undamaged unless written notice is given by the passenger within the periods specified in advance.
Limits of Liability: The liability of the Carrier, its servants and/or agents shall be limited in accordance with Regulation 392/2009 and, where applicable, the 2002 Protocol to the Athens Convention or the Athens Convention. In the event of a shipping incident as defined by Regulation 392/2009, the passenger has the right to claim from the Carrier or the Carrier’s insurer up to 250,000 Special Drawing Rights (SDR) (£235,197.89 or €283,520.45), except in circumstances beyond the Carrier’s control (for example war, natural disaster, act of a third party). Compensation may increase up to 400,000 SDR (£376,090.63 or €453,539.91) unless the Carrier proves that the incident occurred without its fault or neglect. In the event of a non-shipping incident, the passenger has the right to claim compensation from the Carrier up to 400,000 SDR (£376,090.63 or €453,539.91) if the passenger proves that the incident resulted from the Carrier’s fault or neglect. Under the Athens Convention, the limits for death/personal injury are 46,666 SDR per passenger (£43,846.40 or €52,806.26). The limits for cabin baggage are 2,250 SDR per passenger under Regulation 392/2009 and the 2002 Protocol to the Athens Convention (£2,113.62 or €2,546.20), and 833 SDR per passenger under the Athens Convention (£782.32 or €942.88). The Carrier has no liability for valuables unless they have been deposited with the ship’s purser. In that case, liability shall be limited, where applicable, to 3,375 SDR under Regulation 392/2009 or the 2002 Protocol to the Athens Convention (£3,169.55 or €3,819.27), and to 1,200 SDR under the Athens Convention (£1,126.91 or €1,357.96). References to the limits per passenger apply to each carriage. The Carrier may also fully benefit from all applicable laws providing for limitation and/or exemption from liability (including, without limitation, the law or laws of the ship’s flag relating to limitation of liability and/or global limitation in respect of recoverable damage caused by the Carrier).
Independent Contractors and Shore Excursions: The Carrier shall not be liable for anything arising from or connected with the acts or omissions of any independent contractors on board and/or ashore, including airlines, land transport companies, shore excursion providers, onboard medical personnel, and hairdressing and beauty therapy salons.
Pregnancy: We recommend that women who are less than 12 weeks pregnant seek medical advice before travelling. Women who are 24 weeks pregnant, or who will reach 24 weeks during the voyage, must obtain a medical certificate confirming fitness to travel. The Carrier reserves the right to request a medical certificate at any stage of pregnancy and to refuse carriage if the Carrier and/or the Master cannot be satisfied that the passenger can travel safely during the voyage.
Travel Health – Health, Safety and Conduct: The passenger warrants that he/she is mentally and physically fit to travel and will not impair the operation of the ship or cause inconvenience/discomfort to other passengers. The passenger agrees to comply with the Carrier’s rules and regulations and all requests and directions of the Master and the ship’s officers. If the Carrier and/or the Master or the ship’s doctor determines that a passenger is for any reason unfit to travel, or is likely to endanger his/her health or safety, or affect the comfort of others, or is refused permission to land at any port, or the Company responsible for providing his/her care, support, or repatriation is unable to do so, the Carrier and/or the Master shall have the right at any time, without incurring any further liability, to take whichever of the following measures they consider appropriate: i. refuse to embark the passenger at any particular port ii. disembark the passenger at any port iii. transfer the passenger from one berth to another iv. confine the passenger to a cabin, the ship’s infirmary, or another suitable place on board v. require the passenger to remain in the cabin if diagnosed with gastrointestinal illness or another contagious disease vi. administer first aid and/or medical treatment and/or medication, injection, or other permitted substance and/or, where considered necessary or appropriate, arrange for the passenger to be landed at any port and admitted to a hospital or similar institution, with the responsibility of the Master or ship’s doctor being fully limited. For health and safety reasons, the Carrier and/or health authorities at any port may require the completion of a public health form. The passenger must provide accurate information regarding any symptoms of illness, including but not limited to gastrointestinal diseases. The Carrier may, at its discretion, refuse to embark any passenger suspected of carrying a viral or bacterial illness, including but not limited to Norovirus and H1N1.
Travel documents and other requirements: The passenger may be subject to inspection in order to verify any vaccination requirements imposed by government authorities in all countries on the ship’s itinerary, the required health certificates, travel documents, and the health and safety warnings applicable in the ports of those countries. The Carrier is not responsible for informing the passenger of such matters. Depending on the port of call and your nationality, you must carry all necessary travel documents (ID card, passport, visa, etc.). If you fail to obtain all necessary and valid documents, you will not be permitted to board the ship. Persons with Disabilities or Reduced Mobility: If the passenger or any person included in the booking is described as unwell, sick, disabled, or having reduced mobility, the organizer will require full details at the time of booking in order to ensure the passenger’s safety and comfort on board. The Carrier reserves the right not to embark a passenger, or any person considered medically unfit to travel, or whose condition may present a danger to themselves or other passengers. Minors: The Carrier does not accept persons under the age of 18 on the embarkation date.
Dangerous Goods: The passenger may not bring onto the ship any illegal substances or illegal items, knives, weapons, flammable or dangerous goods or substances, or uncontrolled or prohibited objects or items.
Law and Jurisdiction: All matters whatsoever between the passenger and the Carrier shall be governed by the laws of Greece and shall be brought before the Courts of Piraeus, Greece.
